Ed Sheeran wins ‘Shape of You’ copyright lawsuit: Hopefully we can all get back to writing songs than having to prove we can write them | English Movie News


British singer Ed Sheeran has won the lawsuit over allegedly plagiarising artist Sami Chokri‘s track for his hit single ‘Shape of You‘.

In the case heard at the High Court on Wednesday, Justice Zacaroli concluded that Sheeran “neither deliberately nor subconsciously” copied a phrase from ‘Oh Why’ when writing ‘Shape of You’ that is most streamed song in Spotify’s history, the Guardian reported.

Sheeran and his co-writers, Snow Patrol’s John McDaid and producer Steven McCutcheon, denied copying the 2015 song from Chokri, a grime artist who performs under the name Sami Switch. In his claim, he and co-writer Ross O’Donoghue, claimed that Ed’s “Oh I” hook was “strikingly similar” to an “Oh Why” refrain in their track.

Legal proceedings began in May 2018, with Sheeran and his co-writers asking the high court to declare they had not infringed Chokri and O’Donoghue’s copyright. Sheeran also said his reputation had been sullied by the allegations.

Following the hearing, Sheeran took to his handle and issued a statement saying, “I am obviously happy with the result. I feel that claims like these are all too common now. It has become a culture now where settlement will be cheaper than taking it to court, even if there is no base to the claim. It is really damaging to the songwriting industry. There are only so many notes and very few chords used in pop music and co-incidence is bound to happen with 60,000 songs released every day on Spotify and 22 million songs a year. There are only 12 notes available.”

“I don’t want to take any pain or hurt suffered from both sides of this case. But I just want to say that I am not an entity. I’m not a corporation. I am a human being. I am a father, a husband, a son and lawsuits are not a pleasant experience. I hope that in the future, baseless claims like these can be avoided. This really does have to end,” he said.

Sending out a note of thanks to all those who showed him support during the weeks leading up to the court’s verdict, he said, “Hopefully we can all get back to writing songs than having to prove we can write them.”

Chokri and O’Donoghue had issued their claim for “copyright infringement, damages and an account of profits in relation to the alleged infringement”. Both parties anticipated costs in the region of GBP 3 million between them.

Sheeran denied he “borrows” ideas from unknown songwriters without acknowledgement and insisted he “always tried to be completely fair” in crediting people who contributed to his albums.

Sheeran was asked about his decision to settle a claim over his 2015 song “Photograph” which two musicians said had the same composition as their song “Amazing”. The singer agreed to hand over 35% of the publishing revenues, recognised the musicians as co-writers, and paid more than $5 million to them. Asked why he had done this rather than go to trial over what he described as a “nuisance”, Sheeran said, “I took the advice of my lawyers.”

Released from Sheeran’s third studio album ‘Divide’, ‘Shape of You’ stormed charts around the world upon its release in January 2017, becoming the best performing song in the United States that year.
